Terms and Conditions

1. INTRODUCTION

Welcome to The Rep Club. This agreement sets out the terms and conditions (“Terms”) that govern your membership, participation, and use of The Rep Club’s facilities, services and programs – including group fitness classes, open gym access, personal training, and recovery facilities. “Recovery facilities” include but are not limited to infrared sauna, showers and any related amenities.

These Terms, together with your Membership Application Form, Payment Authority, and any other signed documentation, make up the entire Agreement (“Agreement”) between you (“Member”, “Customer” or “You”) and The Rep Club Redfern (ABN: 72 670 040 178) (“The Rep Club”, “We”, “Us” or “Our”).

By signing or activating your membership, you acknowledge that you have read and understood this Agreement and agree to comply with all conditions set out below.

2. MEMBERSHIP DETAILS

2.1 Membership start date:

Your membership starts on the date specified in your Membership Application Form (“Start Date”) once:
a) You have signed and accepted these Terms and the Payment Authority Form; and
b) Your payment method has been verified and the first payment (and any applicable joining fees) and have been processed.

2.2 Commitment period:

Your membership remains active for the minimum term specified in your Membership Application (“Commitment Period”) and continues thereafter on a rolling weekly basis until cancelled under Section 13.

2.3 Cooling-off period:

You may cancel your membership within 7 days of the Start Date (“Cooling-Off Period”) by notifying The Rep Club in writing via email (info@therepclub.com.au). You will be refunded any fees paid, minus processing or administrative fees and the cost of any services used. The cooling-off period does not apply to single visit passes, causal packs or promotional offers.

2.4 Membership suspensions:

You may suspend your membership for a minimum of 7 days and a maximum of 8 weeks per calendar year (“Suspension Period”). Suspension requests must be submitted in writing via email (info@therepclub.com.au) at least 7 days before the proposed suspension start date and formalised by completing of our Membership Suspension Form. A $10 administrative fee applies per suspension request (including extensions). Requests beyond 8 weeks will incur a $10 fee per additional week. All outstanding account fees must be cleared prior to processing. The Suspension Period extends your Commitment period. No facility access is permitted during the Suspension Period.

2.5 Membership renewals:

Memberships automatically renew weekly unless terminated in accordance with Section 13.

2.6 Non-transferrable:

Memberships are personal and cannot be transferred, shared or sold.

2.7 Amendments:

The Rep Club reserves the right to amend these Terms at any time in accordance with NSW law. Updated versions will be published at www.therepclub.com.au. Continued use constitutes acceptance of updated terms.


3. PAYMENTS AND BILLING

3.1 Membership fees:

Membership fees are payable weekly, 7 days in advance, via direct debit from your nominated account or card, as per your Payment Authority Form. All memberships require a minimum 6-week commitment. To adjust your payment day or cycle, please email your request to info@therepclub.com.au.

3.2 Failed or missed payments:

You must ensure sufficient funds are available on each payment date. Failed or dishonoured payments will incur a $5 administration fee per failed transaction and may include additional bank charges from your financial institution. Access may be suspended until outstanding fees are paid. Continued non-payment may result in debit recovery action and associated fees.

3.3 Outstanding payments and debt collection:

If membership payments remain outstanding, and you do not respond to our contact attempts, The Rep Club reserves the right to charge additional collection costs (including agency or legal fees). Members experiencing financial hardship are encouraged to contact us early for assistance.

3.4 Fee changes:

The Rep Club reserves the right to review and amend membership fees and pricing periodically. Members will receive at least 14 days’ written notice before any fee increase.

3.5 Additional purchases:

Charges for personal training, open gym access, recovery / sauna use, merchandise, or other services will be added to your nominated payment method when purchased.


4. ATTENDANCE, LATE CANCELLATIONS AND NO-SHOWS

All bookings have a 12 hour cancellation window. This includes group fitness class bookings, personal training appointments, open gym sessions, and sauna appointments.

4.1 Group fitness classes - Members

No shows and late cancellations within 12 hours of your session booking will result in a $15 late cancellation fee.

4.2 Group fitness classes - Non-members and class pack holders

No shows and late cancellations within 12 hours of your session booking will result in full deduction of the session fee.

4.3 Personal training appointments

No shows and late cancellations within 12 hours of your session booking will result in full deduction of the session fee.

4.4 Open gym bookings – Non-members

No shows and late cancellations within 12 hours of your session booking will result in full deduction of the session fee.

4.5 Open gym bookings – All access members

No late cancellation period or fees apply.

4.6 Sauna appointments – Non-members

No shows and late cancellations within 12 hours of your session booking will result in full deduction of the session fee.

4.7 Sauna appointments – All access members

No shows and late cancellations within 12 hours of your session booking will result in a $15 late cancellation fee.

The Rep Club reserves the right to limit future bookings for repeated no shows.


5. ACCESS AND MEMBER CONDUCT

Members must follow all staff directions, hygiene rules and safety instructions across both fitness and recovery facilities. Unsafe, inappropriate, or abusive behaviour may result in suspension or cancellation without refund. Entry may be refused to anyone under the influence of alcohol or drugs.


6. AGE AND GUARDIAN POLICY

6.1 Age eligibility and requirements:

Members aged 14-17 years may participate with written guardian consent.
Members under 14 years may only attend designated youth programs or events.

6.2 Guardian consent:

Parents or legal guardians must:
• Sign the Minor Consent and Waiver Form before participation.
• Remain on-site during sessions or provide written approval for supervised participation.

6.3 Minor Consent and Waiver Form:

A signed consent and waiver form must be completed by the child’s legal guardian before the minor can attend their first session.

This form will cover:
• Acknowledgement of the child’s participation in physical activity.
• Acceptance of all risks associated with fitness training.
• Agreement to abide by safety guidelines and instructions.

6.4 Restrictions:

Staff may restrict access to certain classes or equipment or modify activities to ensure a safe training environment for minors.


7. ONLINE PURCHASES AND E-COMMERCE

7.1 Order processing:

All orders placed through our Shopify store will be processed within 3 business days. You will receive a confirmation email once your order is confirmed.

7.2 Payment:

We accept various forms of payment, including credit cards, debit cards, and other payment methods supported by Shopify Payments.

7.3 Transaction security:

All payment information is processed securely through Shopify Payments. We do not store or have access to your full credit card details.

7.4 Pricing:

All pricing displayed are in AUD and include applicable taxes. We reserve the right to adjust prices at any time.

7.5 Refunds and cancellations:

Refunds for products purchased online will be handled in accordance with our refund policy, as outlined in Section 8.


8. SHIPPING, DELIVERY, RETURNS AND REFUNDS

8.1 Shipping:

We ship to Australia. Shipping costs and delivery times are calculated at checkout and depend on your location.

8.2 Delivery times:

Orders are typically delivered within 10 business days. Shipping times may vary depending on your location and external factors.

8.3 Shipping confirmation:

You will receive a shipping confirmation email with tracking information once your order has been dispatched.

8.4 Delays:

While we do our best to ensure timely delivery, we are not responsible for shipping delays caused by third-party carriers.

8.5 Returns:

If you are not satisfied with your purchase, products may be returned within 14 days of delivery if unused and in its original condition.

8.6 Refunds:

Refunds are processed within 10 business days after inspection and approval. Approved refunds will be processed back to your original payment method within 10 business days.

8.7 Return shipping costs:

Return shipping costs are the buyer’s responsibility unless the product is defective or incorrect.


9. MEMBERSHIPS, PAYMENT OPTIONS AND SERVICES

9.1 Introductory offer:

Our Introductory Offer is designed for first timers. This offer can only be redeemed once and is limited to one per person. The nature of the offer and expiry period may be subject to change over time. No refunds or extensions are available on our introductory offer.

9.2 Memberships (weekly auto-debit):

1. Unlimited Group Fitness Membership
Unlimited group fitness classes per week*
Minimum term: 6 weeks
Renewal: Weekly auto-renewal

2. Unlimited All Access Membership
Unlimited group fitness classes per week*
Open gym access during designated times.
Unlimited access to our recovery facilities.
Minimum term: 6 weeks
Renewal: Weekly auto-renewal

* Up to a maximum of 2 classes per day.

9.3 Group Fitness Packs:

20 Session Pass - Group Fitness
Provides access to 20 x group fitness classes.
Valid for 6 months from date of purchase.

10 Session Pass - Group Fitness
Provides access to 10 x group fitness classes.
Valid for 3 months from date of purchase.

5 Session Pass - Group Fitness
Provides access to 5 x group fitness classes.
Valid for 1 month from date of purchase.

Single Session - Group Fitness
Provides access to 1 x group fitness class.
Valid for 7 days from date of purchase.

Pricing and expiry period may be subject to change over time.
No refunds or extensions are available on single sessions or class packs.

9.4 Personal training sessions:

30 min | 1-ON-1 | Personal training services
45 min | 1-ON-1 | Personal training services

30 min | 2-ON-1 | Personal training services
45 min | 2-ON-1 | Personal training services


Single sessions, 5 and 10 packs available.

Patrons must complete PT Screening Form prior to their first session.

Pricing may be subject to change over time.
No refunds or extensions are available on personal training purchases

9.5 Open Gym Access:

Single Session - Open Gym
Provides a causal open gym session outside of class times.

Unlimited All Access Membership
Provides unlimited access to open gym sessions outside of class times.

Open Gym Access Guidelines:
  • Open gym sessions provide access to the gym equipment during designated slots outside of class times.
  • Sessions may include the HIIT and/or Strength room pending on availability.
  • Available slots, time frames and rooms will be shown on the schedule and may be subject to change.
  • Open gym sessions do not include access to sauna or recovery facilities.
  • Open gym sessions are not directly supervised by a fitness professional.
  • Participants must be fit and healthy to exercise and use equipment at their own risk.
  • The Rep Club is not liable for any harm or injury that may occur during open gym sessions.
  • Numbers are limited per session to maintain quality and capacity control.
  • Bookings and sign-ins are mandatory for both members and non-members.
  • Any evidence of damage, mess or inappropriate use, may result in The Rep Club revoking access, and patrons being liable to cover the cost of repairs.

9.6 Sauna appointments:

Single - Private
45 min infrared sauna appointment for 1 person only.
Enjoy access to shower facilities before and after use.

Single - Duo
45 min infrared sauna appointment for 2 people.
Enjoy access to shower facilities before and after use.

Sauna - 10 Session Pass
Provides access to 10 x 45 min private infrared sauna sessions for 1 person only.
Enjoy access to shower facilities before and after use.
6 month expiry from date of purchase.

All patrons must complete and sign our detailed Sauna Screening and Consent Form prior to use. We ask that all attendees familiarise themselves and follow our sauna usage, safety and hygiene/etiquette guidelines. Failure to comply may result in revoking access.

Pricing may be subject to change over time.
No refunds or extensions are available on sauna appointment purchases.

9.7 Gift Cards:

Gift cards are valid for 12 months from date of purchase.
Cost is customisable with a minimum spend of $35.
No refunds or extensions are available on gift card purchases.


10. RECOVERY / SAUNA GUIDELINES

The Rep Club provides recovery services, including but not limited to infrared saunas, showers and other recovery amenities (“Recovery Facilities”). Use of these services is entirely voluntary and subject to the conditions below.

10.1 Client eligibility and pre-screening:

By using our Recovery Facilities:
  • You confirm that you are in good physical health and free from medical conditions that may make sauna or heat exposure unsafe.
  • You must accurately disclose any relevant medical conditions prior to participation.
  • You agree to seek medical advice and clearance if required before participating in any physical activity or recovery / sauna service at The Rep Club.
  • You acknowledge that it is your responsibility to seek medical advice if you have any concerns regarding your health or fitness.

You acknowledge that sauna use is not recommended for:
  • Pregnant individuals
  • Individuals with cardiovascular, respiratory or circulatory conditions
  • Individuals prone to dizziness, fainting or heat intolerance
  • Individuals under the influence of alcohol or drugs
  • Individuals recently exposed to UV
  • Individuals with implanted devices (unless cleared by a medical professional)

Age restrictions:
Children under 18 years are not permitted to use our sauna facilities.

Screening and Consent Form:
All patrons must complete and sign our Sauna Screening and Consent Form prior to use and disclose any medical or health conditions (including but not limited to; cardiovascular disease, high/low blood pressure, diabetes, pregnancy, skin conditions, heat intolerance, use of medications affecting heat/temperature regulation etc) that may affect safe use.

This form also confirms that you:
  • Have reviewed and understood all safety and hygiene rules
  • Acknowledge the inherent health risks associated with sauna use
  • Consent to participate at your own risk

You are responsible to advise staff of any changes or updates to personal or medical information provided.

The Rep Club reserves the right to refuse access to Recovery Facilities if it would pose a health or safety risk.

10.2 Acknowledgement of risks:

You acknowledge that the use of infrared sauna and other recovery services involves risks, including (but not limited to) dehydration, dizziness, fainting, overheating, burns, skin irritation, adverse reactions and exacerbation of pre-existing health conditions. You voluntarily participate at your own risk and agree to assume responsibility for your health and safety.

You acknowledge that The Rep Club, and its staff have advised of the importance of:
  • Appropriate hydration before / after
  • Not exceeding the recommended duration (20-30 minutes)
  • Not exceeding the recommended temperature settings (43-60C)
  • Allowing enough time to cool down after use.

You acknowledge that staff may monitor but cannot guarantee prevention of all risks, and you remain responsible for your own health. The Rep Club will maintain regular cleaning, sanitation, temperature calibration and equipment maintenance logs.

10.3 Sauna usage, safety, hygiene and etiquette guidelines:

You acknowledge that all users must:
  • Check in at reception prior to each session
  • Shower before entering the sauna (mandatory after exercise)
  • Wear appropriate swimwear within the sauna
  • Sit on provided towels or mats for hygiene purposes
  • Not exceed the recommended time (20-30 mins per session)
  • Not adjust the temperature beyond the recommended settings (43-60C)
  • Stay adequately hydrated before, during and after use
  • Not use mobile devices or electronics inside the sauna
  • Avoid applying oils, creams or lotions that may damage sauna surfaces
  • Keep noise to a minimum and maintain a calm, respectful environment
  • Not share sauna access with non-paying guests
  • Dispose of towels in the designated towel chute
  • Immediately cease use and notify staff if you become unwell, or experience symptoms such as dizziness, faintness, dehydration or overheating.
  • Not exceed the 45 min session length (including shower/change time). Staying beyond this limit may result in additional session charge.

10.4 Emergency protocols:

In case of an emergency, I authorise The Rep Club to seek medical treatment on my behalf and agree to assume any costs related to such treatment, as also outlined in Section 14.

10.5 Limitation of liability:

The Rep Club is not liable for any loss, damage, or injury resulting from participation or use of its fitness and recovery / sauna services, except in cases of gross negligence, as also outlined in Section 14.

10.6 Indemnity:

You agree to release, indemnify and hold harmless The Rep Club, its employees, and contractors from any claims, damages, or expenses arising from your participation in any fitness or recovery / sauna service, except when caused by The Rep Club’s gross negligence, as also outlined in Section 14.

10.7 Insurance:

The Rep Club maintains all necessary Public & Products Liability insurance, Professional Indemnity insurance (where applicable) and equipment/fixtures property insurance in relation to the fitness and recovery services provided, as also outlined in Section 14. Use of the Recovery Services is subject to the exclusions and limitations of these insurance policies and does not guarantee that every risk is insured or fully covered.

10.8 Booking cancellations:

Our sauna appointments have a 12 hour cancellation window. No shows and late cancellations within 12 hours of your sauna booking will result in full deduction of the session fee (for non-all access members), and a $15 late cancellation fee (for all access members).

10.9 Booking termination or refusal of access:

The Rep Club reserves the right to:
  • Refuse access to Recovery Facilities if your pre-screening indicates contraindications, or if it would pose a health or safety risk.
  • Terminate or suspend your participation if you fail to comply with the Terms of this agreement.

10.10 Amendments:

The Rep Club also reserves the right to amend or change the Recovery Services policy, conditions of use, or pricing at any time.


11. FACILITY CARE AND DAMAGE

Members are liable for any damage to both fitness and recovery equipment or property caused by misuse or negligence. The Rep Club reserves the right to charge repair or replacement costs and restrict future access.


12. DIRECT DEBIT REQUEST SERVICE AGREEMENT (DDRSA)

This section governs the use of direct debit payments processed through the Bulk Electronic Clearing System (BECS). By completing a Direct Debit Request (DDR), you authorise The Rep Club to debit your nominated account in accordance with your membership plan, and the following terms:

12.1 Authority to debit:

By submitting a Direct Debit Request, you authorise The Rep Club Redfern (ABN: 72 670 040 178) to debit your nominated bank account for payments due under your membership plan, or any other services or agreement. Debits will be processed via BECS in accordance with your agreed payment schedule.

12.2 Debit timing and notification:

Payments will be debited in line with your membership or service agreement frequency.
If a debit date falls on a weekend or public holiday, the payment will be processed on the next business day. The Rep Club will provide at least 14 days written notice of any changes to the debit amount or frequency.

12.3 Customer responsibilities:

You are responsible for:
  • Ensuring sufficient funds are available in your nominated account on the scheduled debit date.
  • Providing accurate and current bank account details.
  • Notifying The Rep Club of any changes to your bank account details and updating these details accordingly.
  • Notifying The Rep Club if you wish to cancel or alter your Direct Debit Request with 14 days written notice via email (info@therepclub.com.au).

12.4 Cancellations:

You may cancel or alter your Direct Debit Request by providing 14 days written notice via email (info@therepclub.com.au). Cancelling your DDR does not cancel your membership or remove your obligation to pay any outstanding fees. To cancel your membership, you must follow the cancellation process set out in Section 13. If you cancel your Direct Debit Request without formally terminating your membership, any outstanding balance will remain payable and standard collection procedures may apply.

12.5 Dishonoured payments and fees:

Each dishonoured or failed payment will incur a $5 administrative fee. This may include additional charges from your bank or financial institution. The Rep Club reserves the right to recover unpaid amounts and any associated collection or processing costs.

12.6 Disputes and refunds:

If you believe a direct debit has been processed incorrectly, please contact The Rep Club via email (info@therepclub.com.au). Errors will be investigated promptly and refunded if applicable.

12.7 Confidentiality and privacy:

Your financial and banking details will be stored securely and handled in accordance with the Privacy Act 1988 (Cth) and The Rep Club’s Privacy Policy. Your information will only be disclosed to your financial institution as necessary, or as required by law.

12.8 Compliance:

This Direct Debit Request Service Agreement is governed by:
  • The Corporations Act 2001 (Cth)
  • The Competition and Consumer Act 2010 (Cth) (Australian Consumer Law)
  • The Bulk Electronic Clearing System (BECS) rules, as regulated by the Australian Payments Network.


13. TERMINATION AND CANCELLATION

13.1 Member-initiated termination:

After your minimum Commitment Period, you may cancel your membership by:
a) Providing 2 weeks written notice via email (info@therepclub.com.au) and
b) Completing the official Membership Termination Form.

Terminations will take effect within 2 billing cycles after written notice is provided. Memberships cannot be terminated whilst suspended. All outstanding fees must be cleared prior to terminating.

13.2 Early cancellation:

If you request to cancel before the Commitment Period ends, you may be charged an early termination fee equal to the lesser of:
  • 25% of the remaining contract value, or
  • The amount permitted under NSW Fair Trading guidelines.

13.3 Termination by The Rep Club:

We may immediately terminate your membership if you:
  • Engage in threatening, unsafe or illegal conduct
  • Engage in harassment or violence towards staff or other members
  • Damage property or equipment
  • Fail to comply with safety instructions, policies or rules
  • Breach this agreement or fail to pay fees
  • Allow non-members access to the facilities

Refunds are not provided in cases of termination due to misconduct.


14. RISK, LIABILITY AND INDEMNITY

14.1 Assumption of risk:

You acknowledge that participation in fitness activities, as well as recovery services (including sauna use) involve inherent risks of injury, illness, or death. You voluntarily participate at your own risk and agree to assume responsibility for your health and safety. This includes partaking in group fitness classes, personal training, open gym sessions, and using our recovery / sauna facilities.

14.2 Health and medical declaration/clearance:

You confirm that you are in good physical health and have disclosed any relevant medical conditions prior to participation. You agree to seek medical advice and clearance if required before participating in any physical activity or recovery / sauna service at The Rep Club. You acknowledge that it is your responsibility to seek medical advice if you have any concerns regarding your health or fitness.

14.3 Emergency medical treatment:

In case of an emergency, I authorise The Rep Club to seek medical treatment on my behalf and agree to assume any costs related to such treatment.

14.4 Limitation of liability:

The Rep Club is not liable for any loss, damage, or injury resulting from participation or use of its fitness and recovery / sauna services, except in cases of gross negligence.

14.5 Indemnity:

You agree to release, indemnify and hold harmless The Rep Club, its employees, and contractors from any claims, damages, or expenses arising from your participation in any fitness or recovery / sauna service, except when caused by The Rep Club’s gross negligence.

14.6 Property:

The Rep Club is not responsible for loss or damage to personal items. Members are encouraged to secure valuables.

14.7 Insurance:

The Rep Club maintains all necessary Public & Products Liability insurance, Professional Indemnity insurance (where applicable) and equipment/fixtures property insurance in relation to the fitness and recovery services provided.


15. HEALTH AND SAFETY

You acknowledge that exercising and using The Rep Club’s gym and recovery / sauna facilities involve inherent risks of injury. You assume all risks related to your health and fitness. It is your responsibility to monitor your physical health and exercise to a level that is appropriate to your fitness and capabilities.

All patrons must:
  • Follow all instructor guidance and safety procedures.
  • Notify staff immediately if you are pregnant, injured, or have a medical condition affecting participation.

The Rep Club reserves the right to restrict participation for health or safety reasons. Medical clearance may be required to resume exercise after pregnancy, illness or injury, or to partake in recovery / sauna use.


16. PHOTOGRAPHY AND MEDIA

The Rep Club may capture photos or videos for marketing and social media purposes. By attending, you consent to the use of your image, unless you opt out in writing before participation.


17. PRIVACY

Your personal and financial information will be handled in accordance with the Privacy Act 1988 (Cth) and The Rep Club’s Privacy Policy. You may access and correct your information at any time by contacting us in writing.


18. GOVERNING LAW AND JURISDICTION

This agreement is governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of NSW for any disputes arising under this Agreement.
